摘要
英美法系及大陆法系都对亲属作证豁免的制度进行了详尽的规定,我国台湾、香港、澳门也设立了亲属作证豁免的制度,但是我国大陆的诉讼法却未对该制度进行规定,只是单纯强调证人的作证义务。本文对几个主要国家的亲属作证豁免制度进行列举、分析,并对该制度存在的法理基础进行论证,进而对我国的亲属作证豁免制度进行构建。
The immunity system of relatives＇ witness is included in law system of Britain and America.China Taiwan,Macao and Hongkong do so.But there is no stipulation of immunity system of relatives＇ witness,and there is an obligation of human witness.In this paper,the writer listed and analyzed relatives＇ witness immunity systems of several main countries to demonstrate and build immunity system of relatives＇ witness in our country.
