摘要
饮用水和空气一样是生命须臾不可或缺的环境要素。在现今社会,每个人都应该有获得保障生命健康和满足其基本生活需要的饮用水的权利,但是,当一部分人无法实现这一权利时,法律没有给予应有的救济。文章旨在论述饮用水权与取水权、环境权之间的关系,进而明确其权利属性,为在法律上确立饮用水权奠定基础。
Drinking water and air are both environmental factor which is indispensable to human life.In today's society,everyone should have right of getting enough drinking water to protect health and to meet the basic needs of life.But,when some people can't realize this right,the law does not give relief to them.This paper aims to discuss the relationship between drinking water right and water right and environmental right,then to make clear the attribute of drinking water right,finally to lay a foundation of determining drinking water right as a legal right.
