U.S Patent Reform and Its Influence on China

美国专利制度改革对于中国既是机遇又是挑战。一方面,美国专利制度改革会加速中国企业的专利成果转化过程并降低诉讼风险,另一方面,美国专利制度改革可能会对中国政府和中小企业造成不利影响。建议中国企业部署更适合的专利战略,同时对海外竞争对手进行专利跟踪;中国政府为赴美申请专利的中国企业组织专项培训,对中小型企业提供法律援助和资金支持;同时加强与美国在知识产权方面的交流与合作,继续完善中国的知识产权制度。

To China, the U. S. Patent Reform is both an opportunity and a challenge. On the one hand, the U. S. patent reform could benefit Chinese enterprises in accelerating the transformation process of patent and reducing the risk of litigation ; on the other hand, it may influence Chinese government and Chinese small and medium-sized enterprises adversely. The suggestions are that Chinese enterpri- ses may deploy more suitable patent strategy and trace patent research activities of their overseas competitors ; Chinese government may organize special training for the Chinese enterprises which need to apply U. S. patent, and provide legal assistance and financial support to small and medlum-sized enterprises; it may also strengthen exchanges and cooperation with the United States on intellectual property rights, and continue to improve Chinese intellectual property system.
