论法律多元文化对法律实施造成的困境及对策

On the Predicaments of Law Enforcement Arising from Multi-legal Culture and Countermeasures

任何社会的发展都需要多种因素和力量在其中发挥作用,一个国家法律实施目的的达成同样要有多种因素共同协调和影响。这其中法律多元文化作为我国文化的构成部分,对法律实施的成效有重要的影响。因为法律多元文化本身具有很大的矛盾性和冲突性,使得法律实施难以达到效果,并且带来了一系列矛盾和困境。文章正是针对于此作出论述,以期为此困境的解决提供一定的参考。

The development of a society depends on the harmonious work of a variety of factors and forces,and similarly,the successful enhancement of laws in a country also relies on the coordination and influence of various factors.In China,the multiple-legal culture,as a component of Chinese culture,has a strong impact on the effectiveness of law enforcement,because the multi-legal cultrue itself is fraught with contradictions and conflicts,which prevents the law from being effectively operated,and brings about,at the same time,a series of contradictions and dilemmas.This article makes an exposition about this issue,and intends to provide some countermeasures to it.
