Main Principle of Arbitration Law and Suggestion for Amendment on China's Arbitration Law

阐述了仲裁委员会、仲裁法律关系以及仲裁规则的本质、特征、功能 ,认为仲裁法律关系是一种特殊的民事法律关系 ,仲裁过程中适用的仲裁规则是一种特殊的民事合同 ,并对我国仲裁法的修正及完善提出了建议。

This article defines and analyses the function, essence, feature of arbitration commission, arbitration law relationship and arbitration procedure rules. The author points out that arbitration relationship is a special civil relationship and the arbitration procedure rule is a special civil agreement. Suggestions on how to upgrade and amend China's arbitration law have been given according to the author's understanding of the arbitration jurisprudence.
