摘要
控制下交付,是指法律授权的机关根据侦查犯罪的需要,对正在发生的涉及给付毒品等违禁品或者财物的犯罪活动,依照规定对犯罪活动进行监控以查明案件真相、查缉犯罪嫌疑人的技术侦查措施。随着经济社会的发展和犯罪情况的不断变化,控制下交付适用的范围必须依照相关法律的规定,结合当前及今后犯罪侦查的实践需要不断扩展。适用控制下交付的侦查措施,不仅要遵从合法性、有效性、策略性、协同性、操作性、保密性等原则,还要遵从重罪原则和时限原则。
Controlled delivery refers to the measures taken by legally authorized organizations aiming at monitoring the occurring cases or crimes involving property or contrabands such as drugs.With rapid socio-economic progress and evolution of crimes,the application range of controlled delivery should be stipulated and broadened by law and in accordance with the needs of the real-world situation.The concrete measures of controlled delivery should conform to principles of legitimacy,of effectiveness,of strategy,of coordination,of practicality,of confidentiality,of major crime,and of time bar.
