GATS National Treatment Principle in the use of the Unspoken Rule——Taking Canada Journal Import Measures as an Example

将国民待遇原则引入服务贸易领域,是促进服务贸易自由化的一项重要措施。然而,GATS国民待遇条款本身存在的一些缺陷不可避免地影响到其适用的效力,使其法律约束力大打折扣。本文以加拿大期刊进口措施案为例,分析了GATS国民待遇原则运用中存在的潜规则,指出了其中的启示作用,并提出了我国应采取的具体措施。

The national treatment principle applied in the field of service trade to promote the liberalization of trade in services is an important measure.However, GATS national treatment clause itself has some defects which inevitably affect its validity, making it legally binding at. This paper analyzes unspoken rule of national treatment principle of the GATS, taking Canadian Journal of import measures as an example. Then it points out the Enlight- enment of China, and puts forward the concrete measures.
