从诚实信用原则看大学生就业中的毁约问题 被引量:1

摘要 当今社会,大学生"就业难"与"频毁约"的并存已是不争的事实。"未就业先毁约"的现象愈演愈热引起各方讨论,要求大学生讲诚信、守诺言的讨论得到越来越多的关注。本文通过收集大学生就业过程中毁约的数据,以数据为依托,从民法的诚实信用原则的角度,定位大学生毁约的性质,分析其原因及影响,探究其中存在的利益冲突,并指出问题的关键在于诚实守信与自身利益的平衡。通过对现有解决方式的对比分析,在现有方式之上进行改进,从制度方面提出两种解决方案。 In the modem society, it is an indisputable fact of graduates that the difficulties in finding jobs coexist with the frequent breach of contracts. Breaching in contracts while they haven't find the jobs has aroused much discussion, and the discussions about requiring undergraduates to be honest as well as keeping promise are payed more and more close attentions. Through data collection, this paper which is based on data, positions the nature of the graduates' breach of contracts, analyses the causes and effects, explores the conflict of interests there, and points out that the key of the problem is the balance between the interests of themselves and the principle of good faith from the civil law. With the comparative analysis and the improvements of the existing solutions, this paper proposes two solutions from the system.
