中国“拜杜法案”体系下高校专利申请增长分析

Analysis on Rising of Patent Application of China's Universities under Bayh-Dole Act System

在2011年以来中国专利申请高速增长、中国成为世界专利申请第一大国的背景下,对中国专利申请的重要主体之一——高校的专利申请增长现象进行了统计分析。借鉴国际经验,提出了中国"拜杜法案"体系促进高校专利申请的假设。用统计分析、非参数检验以及案例研究等方法对假设进行检验。认为:以《科技进步法》(2007年修订版)为主要代表的中国"拜杜法案"体系对高校专利申请增长产生了积极影响,但这种影响在较长时期内才显现出来,并表现出一定的区域性差异。

Under the background that China has been bursting in patent application and has been the nation of which patent application is the largest since 2011,this paper makes a statistical analysis on the patent application trend of China＇s universities,one of the most important applicant subject.Using the experience of international experience,it puts forward the hypothesis that China＇s Bayh-Dole Act has contributed to the rising of universities＇ patent application.Through descriptive analysis,non-parameter test and case study,it verifies it.The final result indicates that,China＇s Bayh-Dole Act system represented by The Law of the People＇s Republic of China on Science and Technology Progress（2007 revised edition）issued in 2008,in short term,does has positive impacts on the rapid rising of patent application from higher education system,and these impacts would take on in a relatively long term and are characterized by regional difference.
