摘要
行政诉讼原告资格是关系到当事人诉权的重要问题,但是我国关于证券监管行政诉讼原告资格的司法审查的研究相当薄弱。根据对我国证券监管行政案件原告资格的司法审查现状的考察,我国司法审查中存在若干不足,亟需矫正,以期促进对当事人诉权的有效保护。
The plaintiff qualification in the administrative litigations is a very important issue which deals with the litigation rights of the litigants.However,research into the examinations about the plaintiff qualifications in the administrative cases concerning the regulation of the securities market is much weak.Based on the current situations of the legal examinations about the plaintiff qualifications in administrative cases,this article analyses the weaknesses of the legal examinations,putting forward some correcting measures so that the litigants＇ rights could be better protected.
