试论非物质文化遗产跨国争议的仲裁解决机制

仲裁机制在非物质文化遗产跨国争议的解决中具有明显的优势。在当前的国际仲裁机构中,常设国际仲裁法院,最适合解决非物质文化遗产的跨国争议。常设国际仲裁法院有必要完善现有仲裁机制,建立一套解决非物质文化遗产跨国争议的特殊机制。这一特殊机制包括设立专门的仲裁庭、成立专家小组、规定友好仲裁等多方面的内容。

The arbitration machining has obvious advantages in settl ing transnational dispute of intangible cultural heritage.Among the current international arbitral agencies,Permant Court of Arbitration is the most suitable institution in settling transnational dispute of intangible cultural heritage.However,it in is necessary for Permant Court of Arbitration to improve existing arbitrate machanism and establish special system.And content of the special machanism includes the establishment of technical arbitral court,expert＇s group and amiable arbitration,etc.
