摘要 鸿道集团与广州医药集团之间的法律关系属于商标使用许可合同关系;对于"知名商品",应结合标志和物质产品两方面内容来理解其确切含义,将"知名商品"仅理解为"知名标识"而不包含物质产品的内容是一种错误的观点;从加多宝公司与广药集团纠纷案件的事实来看,原"知名商品"王老吉凉茶所使用的"王老吉"注册商标与其所标示的特定凉茶产品已经分离开来,由此证明了"知名商品"要素的可分离性;按照"谁付出、谁受益"的规则,将原知名商品"王老吉"凉茶特有包装、装潢归属于加多宝公司符合公平原则的基本精神。 The legal relation between Hongdao Ltd. and GuangZhou pharmaceuticals Ltd. is trademark licensing contractual relation. Both of the mark and production should be considered while defining famous goods, so it is wrong to consider the "famous goods" only as "famous marks" without the material production. From the dispute between JDB corp. and Wanglaoji corp., a there is a phenomena that there is a separation between the registered trademark "wanglaoji" and the peculiar herbal tea on which the trademark is used, which proves that the elements of the "famous goods" can be separated. According to the principle of "who pays, who benefits", attributing the interest of the peculiar packaging and decoration of the famous goods, "wanglaoji" herbal tea, to JDB corp. complys with the principle of fairness.
