有关《缺陷汽车产品召回管理条例》的解读

Unscramble about the “Ordinance for Automotive Recall of Defected Parts”

汽车召回，指由缺陷汽车产品制造商进行的消除其产品’可能引起人身伤害、财产损失的缺陷的过程．包括通知、修理、更换、收回等具体措施。缺陷汽车召回制度最早源于美国。2012年10月22日，国务院公布《缺陷汽车产品召回管理条例》（以下简称《条例》），自2013年1月1日起施行。相对2004年发布的《缺陷汽车产品召回管理规定》（以下简称《规定》），该《规定》在召回程序、监管措施上进一步完善，尤其是对隐瞒汽车产品缺陷、不实施召回等违法行为加重了处罚力度。

The automotive recall means the process by manufactures of automotive products to eliminate defects of its products which may cause property loses or human injury, including detail measures of recall, replacing, repair and notify, and etc. Since Oct. 22, 2012, the 《Ordinance for Automotive Recall of Defected Parts》 has been issued, by the signing order of the Premier of State Department of China, Mr. WEN Jiabao, and will be implemented starting from Jan. 1, 2013. As compared to the 《Ordinance for Automotive Recall of Defected Parts》issued in the year of 2004, further perfection are made in monitoring measures and program of recall, especially severe punishment are strengthened on illegal behaviors as not implementing of the recall, hiding of the defects of automotive products and etc.
