论食品安全事故中的政府责任

摘要 从"三鹿奶粉"到"瘦肉精"、"染色馒头"事件,一系列典型的食品安全事件的频出使食品安全问题成为当今社会关注的焦点。食品从种植养殖到餐饮消费的一系列过程中均有可能受到有害物质的污染,导致食品存在危害,构成食品安全问题,对公众健康造成严重威胁。作为政府,应对食品安全负有监管的职责,发生食品安全事故时,政府应承担因疏于管理造成的替代责任,政府对行政机关的行为所造成的损害应承担赔偿责任。 From the "Sanlu milk powder incident" to the "Clenbuterol" and "dyed bread" events that have been exposed recently, series of typical food safety incidents resulted in the emergence of food safety issues become the focus of attention. Food from plant breeding to food consumption, a series of food processing can be contaminated by harmful substances, resulting in harmful food there, thus constituting food safety issues, and poses a serious threat to public health. The government must be responsible for food security supervision, Food safety accidents happened, the government shall be liable for the neglected by alternative responsibility, Gov- ernment administrative organ of the behavior of the damage shall be responsible for compensation.
