我国体育彩票业政府规制改革思路

Reform in Governmental Regulation of China's Sports Lottery

为解决我国体育彩票业的外部性、信息不对称以及市场欠缺等问题,进行政府规制是非常必要的。由于我国体育彩票业政府规制目前出现的规制体系缺位,规制不力,法规建设严重滞后,规制政策缺位与越位情况等发展困境,要求政府规制必须以市场为导向,维护公益性质。通过立法确定体育彩票市场法律关系,明确规制机构设置;完善规制机构设置,强化规制权力配置;健全规制政策,提高规制效率;强化对我国体育彩票规制者的规制,完善体育彩票的政府规制。

This paper studied the present problems of regulations and system of China＇s sports lottery and explored into measures of its reform.It was held that governmental regulation was necessary so that the lottery market could target at the market and safeguard the public welfare.The legal relationship of the sports lottery market could be de fined and the set of regulatory agencies could be clarified.Meanwhile,regulatory institutions could be set up and power could be distributed reasonably.Furthermore,policies could be perfected so that efficiency could be reached.Regulators should also be regulated.
