我国非营利组织法律制度的完善

On Consummating the Legal System of Chinese NPOs

中国经济的迅速腾飞,一方面取得了很大的成就,一方面也积累了大量的社会矛盾。为了化解这些矛盾,实现中国在稳定和谐中持续发展,必须进行社会管理体制改革,加强非营利组织的作用,使社会承担更多的责任,减轻政府的压力,提高公民对于公共事务的参与度。目前,中国现行的非营利组织法律制度在审批上过于严苛而又监管缺位,同时缺乏足够的税收激励制度和人力资源保障制度,这样的法律制度缺陷成为了中国非营利组织的发展瓶颈。针对这些问题,要削弱控管制度加强监管制度,增加财政激励保障人力资源,以此为目标完善非营利组织的法律制度,促进社会的和谐发展。

China＇s rapid economic growth has gained great achievements on the one hand,but on the other hand has accumulated a great deal of social contradictions.In order to resolve these contradictions,to achieve stability and harmony in China for the sustained development,the need for social management system reform,strengthening the role of nonprofit organizations,the community takes more responsibility,to reduce the pressure on the government to improve citizen participation in public affairs for.At present,China＇s current legal system,non-profit organizations in the regulatory approval but is too harsh on the absence,while the lack of adequate tax incentives system and human resources and support systems,such as the Chinese legal system,non-profit organization defects in the development bottleneck.To solve these problems,we should weaken the control system;strengthen the supervision system to increase the protection of human resources,financial incentives,as a goal of improving the legal system,non-profit organization to promote the harmonious development of society.
