传统侵权法律适用关注的是选择过程的合法性,缺少对所选择的法律适用结果的关注,以至于忽视了在法律选择过程中对当事人利益的保护。分析在侵权法律适用中保护当事人利益原则的理论基础及必要性,并结合《中华人民共和国涉外民事关系法律适用法》,概括我国在侵权法律适用方面保护当事人利益的具体体现,并分析在司法实践中保护当事人利益原则如何实现的相关问题。

The traditional Infringement Law focuses more on the validity of the application,but in lack of attention on the protection of the party＇ s interest behind this process.This article analyses the importance of maintaining the party＇ s legal benefit while Infringement Law is applied.Besides,it summarizes the examples of such application and related scenarios by combining The Republic of China Civil Infringement Law application regulations.
