超越惩罚:罪犯再社会化的障碍及消解路径研究综述

Beyond Punishment: Summary of Research on Criminals' Re-socialization Obstacles and Their Removing Routes

在当前社会急剧转型期,犯罪率居高不下,罪犯的再社会化问题日益引起学界的关注。其中,罪犯再社会化的障碍及其消解路径成为关注的焦点。监狱行刑罪犯再社会化的障碍主要在于监禁刑的手段与目的之间的深刻矛盾。社区行刑罪犯再社会化的障碍主要有社会对社区矫正的理念认识不足、对矫正对象支持有限甚至排斥,社区矫正制度不健全等。为消解罪犯再社会化的障碍,学者们提出了发展社区处遇、完善现有的社区矫正制度和监禁处遇、加强对出狱人的保护等对策建议。但既有研究在研究方法及研究视角等方面仍存在不足,应从罪犯自身角度加强对其再社会化障碍的实证研究并从法学、社会学、社会工作等多学科视角进行对策探讨。

In the current drastic transformation period the rate of crime stays high.Therefore the re-socialization of criminals is increasingly attracting the attention of the academia and the re-socialization obstacles and their resolution routes have become the focus of attention.The main re-socialization obstacle of the criminals in prison is the deep contradiction between means and purpose.That of those in community includes： society have not fully understood the community correction concept,seldom support community correction criminals and even reject them;community correction system is not perfect,etc.In order to remove these obstacles,the scholars propose the community treatment be developed,the community correction system and imprisonment be improved and the protection of the criminals who have been released be strengthened.However,previous studies are still deficient in research methods and perspectives.We should strengthen the empirical research from the offender＇s own point of view and try to put forward countermeasures from the perspective of law,sociology,social work and other subjects.
