托运行业的“黑社会”及其防控对策研究——对浙江省30个涉黑犯罪的实证分析

The Preventive Measurement against Underworld in the Consignment Trade——Research on Thirty Cases of Zhejiang Underworld Property Organization

浙江省黑社会性质组织犯罪"向经济领域渗透"的一个最大特点就是通过托运行业实现暴力垄断,建立起黑社会性质组织犯罪的经济结构。获取非法利益,暴力垄断市场;通过企业公司组织形式进行违法犯罪活动;强化组织结构,严密组织管理制度,实施多元管理手段;利用金钱拉拢腐蚀有关机关人员寻求保护。我们应该采取"预防为主、打击为辅、专项治理、全民动员"的原则,积极研究黑社会性质组织犯罪的防治措施,加强托运行业市场监管,完善托运市场运行制度,加强执法打击力度,实行托运行业"打黑除恶"专项治理;消除制度性腐败的社会基础,增强权力制约机制;完善立法,借鉴国外经验,以此维护社会经济秩序的有序运行。

One of the biggest characteristics about the underworld property organization crimes ＂penetrating into the economic fields＂ in Zhejiang province is that they realized monopoly and establishing of economic structure through the consignment trade.To get illegal benefit and violent monopoly market,these underworld property organizations conducted illegal and criminal activities through the enterprise inc organization.At the same time,these underworld property organizations implemented diversified management means to strengthen organization structure and strict on the organization and management system,then used much money to corrupt authorities for protection.We should take ＂prevention、strike、administer、mobilization＂ as the principle,and positively carry out the research on the prevention measures of the underworld property organization crimes,strengthen supervision of the consignment trade,perfect market operation system,strengthen the intensity of law enforcement,insist on the special treatment of the consignment trade ＂crime crackdown＂,eliminate the social basis of institutional corruption,enhance the power restriction mechanism,perfect legislation,draw lessons from foreign experience,to maintain the social and economic order operation orderly.
