国外证人证言可信性评估的研究述评

Review of the Assessment of the Testimony Credibility

证人证言是诉讼中运用最为广泛的证据之一,如何有效地评估证人证言可信性是法律工作者最为关注的问题之一。国外关于证人证言可信性评估主要围绕证人的非言语行为、证人的言语行为及证人的生理指标三个方面。本文介绍了这三方面评估的方法、原理、程序、检验,并逐一作出了评价,以期对我国的司法实践有所启示。

Testimony is one of the most widely used evidences. How to effectively assess the credibility of testimony is one of the issues which legal practitioners most concern. The credibility of testimony is always as- sessed abroad from the three aspects of non-verbal behavior, verbal behavior and physiological indicators of wit- nesses. This article describes and assesses the methods, principles, process and examination of these three as- pects, in the hope that it will benefit Chinese judicial practice.
