打击“地沟油”犯罪的司法困境与立法对策

The Judicial Dilemma and Countermeasures Against the Crime of "Drainage Oil"

解释了"地沟油"及其犯罪的概念界定及其利害两面,从低成本高利润、检测鉴定标准缺乏、食品安全监管体系不健全、法律责任难落实、餐厨垃圾回收机制缺失等方面分析了"地沟油"泛滥的深层原因,并结合司法实践提出了打击制售"地沟油"行为的法律瓶颈与司法困境,最后从完善刑事立法、统一鉴定标准、加强宣传力度、强化监督管理、建立长效制度建设等方面提出了应对措施。

This paper explained the concept of the crime of ＂drainage oil＂, and analyzed tile causes from its low cost and high profit, the lack of standards of detection and identification, the imperfect food safety regulatory system, the difficulty to fulfill the legal responsibility and the lack of food waste recycling mechanism. Combining with judicial practice, this paper explained the legal bottleneck and judicial dilemma against the crime of ＂drainage oil＂, and put forward the countermeasures from the aspects such as perfecting criminal legislation, unifying appraisal standard, en- hancing propagandas, strengthening supervision and management and establishing long-term system construction etc.
