摘要
金融ADR机制是金融消费者保护体系构建的重要组成部分,对金融消费者权利的救济至关重要。从国外看,英国创建了富有特色的金融巡视员制度和金融仲裁制度;澳大利亚成立了高效便捷的金融服务督察机构;日本创设了具有选择性的纠纷处理机制;荷兰建立了独具特色的金融服务投诉局。反观我国金融ADR机制,尚存在诸多问题,协商和解、调解、仲裁等机制难以达到应有效果。尝试借鉴英国、澳大利亚、日本、荷兰等国ADR机制的先进经验,以此寻求我国的金融ADR机制完善之道。
The financial ADR mechanism is an important part for building financial consumer protection system and plays a critical role in relieving financial consumer's rights. In abroad, Britain has created a distinctive inspector of the financial system and financial arbitration system; Australia has set up a convenient and efficient financial service inspector; Japan has created a selective dispute resolution mechanism; Netherlands has established a unique KiFiD. China's financial ADR mecha- nism, however, still has many problems so that the due effect cannot be achieved through negotiation, mediation, and arbi- tration. This thesis tries to draw lessons from the advanced ADR mechanism experience in the various countries so as to seek a way of perfecting our financial ADR mechanism.
