Probing into the Legislation in Chinese Residential Areas of Shanghai during the Revolution of 1911

辛亥革命时期上海华界立法主要经历了三个阶段,每个阶段的立法内容都有自己的特色。与上海租界的立法相比较,辛亥革命时期上海华界的立法具有一些特性,主要是:从法规体系和单个法规方面来审视,其立法缺乏系统性;从立法内容方面来分析,其立法具有革命性;从民国立法史方面来考察,其立法具有开创性。辛亥革命时期上海华界立法还有一些问题值得关注,其中包括立法后的实施、立法的意义、与中央立法的关系等问题。

Compared with the legislation of the Shanghai Concession that has undergone three different periods, the legislation of Chinese residential areas in Shanghai has its own features. It is not systematic in the law system and independent regulations; it is revolutionary in content; it is groundbreaking from the perspective of legislative history in the Republic of China. There also exist a lot of problems that worthy of attention like the implementation of the law, significance of legislation, and relationship with legislation of the central government.
