现代民法中表示主义的兴起源于"信赖保护",意思表示的客观解释、德国民法典的表示立场、物权变动的公示无一不是权利外观理论的体现,但私法自治才是所有权善意取得制度的正当性基础。正确认识所有权的善意取得制度的历史演化、构成要素、理论基础,跳出原始取得的既有框架约束,将之定位于继受取得,对于正确适用善意取得制度具有重要意义。
