摘要
捐赠是赠与的一种特殊形式,具有自己的特征:捐赠是诺成性合同,是非要式合同;接受捐赠的当事人必须具备法定的资格;捐赠人在提供捐赠时不能附有义务;捐赠人对其捐赠物品必须承担瑕疵担保责任。捐赠人承担违约责任的方式是有限的。
Donation is a special form of giving. It is a promissory contract. The accepters must have special qualifications, and donators should not ask for obligations from accepters. Donators are to guarantee the donated ar- ticles free from defects.
