关于矿业权法律术语英译的探讨

Discussion on English translation of legal terms about mineral rights

在不同的法律体系中几乎没有完全对应的法律术语概念,正确地翻译法律术语在比较法研究中非常重要。我国矿业权包括探矿权和采矿权,而目前这三个法律术语的英译却是五花八门没有定论,即使一些权威法律词典也有相互矛盾之处。对于矿业权、探矿权、采矿权的英译应当从我国的制度出发,明确其概念以及内涵,然后遵照一定的翻译原则,在英美法的矿权制度中找出最能明确表达其意义的词汇。

As there are not totally corresponsive legal terms in different legal systems,it is foremost to correctly translate legal terms in comparative law study. Mineral rights in China include exploration right and mining right. English translations of these legal terms are diverse now, and even some authority law dictionaries contradict each other. While translating these three legal terms into English, it is reasonable to definite the concept and content of the terms in Chinese legal system firstly, and then follow certain translating rules, finally find out the most suitable terms in mineral rights regulations from Anglo-American legal system.
