技术侦查立法化的利弊探析——以刑事诉讼法为视角

技术侦查措施,是侦查机关在办理危害国家安全和严重扰乱社会治安秩序的犯罪案件中,依据国家赋予的特殊侦查权力,运用各种专门的技术方法或技术装备进行的秘密侦查行为。随着科学技术的发展,一些人在从事违法犯罪活动的同时也大量的运用现代科技逃避法律的制裁,在刑事侦查领域,有些案件运用传统的侦查措施已经无法达到破案的目的,往往需要采取技术侦查措施。2012年3月14日第十一次全国人民代表大会第五次会议通过的《刑事诉讼法》第二章增加了一节"技术侦查"的内容。技术侦查首次以立法的形式被确立,并立即引起了社会的极大关注。就侦查技术立法化的利弊予以分析探析,以求能进一步规范技术侦查措施的实施与运用。
