监外执行罪犯脱管漏管的调查与思考——以重庆市三峡库区为样本分析

An Investigation and Thinking on the Escaping and Neglecting of Ciminals Serving Sentence Outside Prison——Taking Three Gorges Reservoir Area in Chongqing city as a sample analysis

暂予监外执行作为一种非监禁的行刑方式,虽然在一定程度上显示了行刑方式的灵活性、效益性和人道性,但由于立法缺陷、制度设计不合理等方面的原因,使监外执行罪犯的脱管漏管成为当前司法实践中较为突出的问题之一。这些弊端的存在严重损害了监外执行制度的严肃性和权威性,加强对监外执行罪犯的监管必须进一步完善立法,健全监管制度,加强法律监督,共同促进监外执行的公平正公正。

The temporary execution outside prison as a non-imprisonment execution shows the flexibility, efficiency and humanity of execution mode to a certain extent, but because of the imperfect legislation, unreasonable system design and other reasons, the escaping and neglecting of criminals serving sentence outside prison has become one of the most prominent problems in current judicial practice. These drawbacks severely impair the seriousness and authority of the probation system. In order to strengthen the supervision of criminal execution outside prison, the legislation and supervision system should be further improved, legal supervision should be strengthened, and thus the fairness of execution outside prison can be jointly promoted.
