论网络诈骗罪的法律规制及防范对策

Analysis of Legal Regulation and Protection Countermeasures of Crime of Network Fraud

网络在给人们带来便捷生活方式的同时,也在无形中为网络诈骗犯罪活动的滋生提供了新的温床。由于立法缺失及配套设施的不完善,我国还不能对网络诈骗活动进行有效地防范与控制。本文在简要介绍网络诈骗罪的基础上,提出了我国应如何规制网络诈骗罪,以弥补立法上的漏洞,从而有效地打击并遏制网络诈骗。

The internet technology brought people a new convenient lifestyle, at the same time virtually offered the new breeding ground for the crime of network fraud. As the inadequate legal system and the lack of equip facilities, it hindered us in preventing and controlling the crime of network fraud. On the basis of introduction of the crime of network fraud, this paper put forward some suggestions on how to regulate the crime of network fraud, so as to make up for legislative loop- holes and effectively combat and curb Internet fraud.
