试析船员配员相关关系的法律规制

摘要 目前我国的船员配员已居世界首位,但船员、船员公司、船公司三者之间所产生的劳动法律纠纷日趋严重,且在海事管理工作中,船舶配员问题长期以来一直是一个"老大难"问题。本文通过分析现行船舶配员相关法律制度存在的缺陷,从劳动与资本的博弈、权利与效率平衡的视角,提出完善船舶配员相关法律制度的可行建议。 At present,ship manning in China has ranked the first in the world.But the labor legal disputes among seamen,ship-manning companies and shipping companies are on the rise,and ship manning is the most difficult problem in marine management.From the perspectives of the gaming between labor and capital as well as the balance between right and efficiency,this paper analyzes the defects in related legal systems of ship-manning and puts forward feasible strategies to improve the legal regulation of ship-manning.
