摘要
就业是民生之本,促进就业是现代政府不可回避的基本职能。我国实行的是"政府促进就业"的长期战略和政策,基于制度正义理论,可以从实质正义和程序正义两个层面来分析,其实质正义性体现在该政策的基本内容和结果上,反映的是受政策规范和调控的权利分配的合理性与正当性;程序正义性体现在该政策实施过程或者程序本身的正当性,实质正义性和程序正义性二者是相辅相成的。
The employment has a vital bearing on the people's living,so it is an unavoidable fact that a modern government should promote employment.Employment promotion in China is carried out by government as a long-term strategy.According to the institutional justice theory,it could be analyzed in the respects of substantive justice and procedural justice.Substantive justice is embodied in the basic content and results of the strategy and reflects the rationality and legitimacy of the rights allocation;procedural justice is embodied in the implementation of the strategy as well as the legitimacy of the process itself,so they should be complementary.
