浅议劳动争议的民间性ADR——以协商、民间调解制度为中心

摘要 以协商和民间调解制度为核心的民间性ADR,较其它纠纷解决机制具有共通性、灵活性和易便性等方面的特点,使得其更能够有效的解决劳动争议。但是,这种民间性替代纠纷解决机制,目前却面临着当事人协商地位不平等,调解制度不完善等缺陷与不足。针对这些问题,我们要分别对协商和调解制度进行完善,并在此基础上建立适合我国国情的以协商和民间调解制度为核心的劳动争议民间性ADR体系,作为多元化纠纷解决机制中的一个重要组成部分。 Because folk ADR which is the center of conference and civil mediation is more common,flexible,simple and convenient than other strife solutions,it can be better to resolve the labor conflicts.But his civil autonomous Alternative Dispute Resolution is faced with many problems and imperfection in the field of public power and the process of Labor-management strife solution.So it is imminently needed to improve and perfect these problems and build the reasonable multi-routes of working conflict solutions to accommodate the reality,especially to perfect the conference system and folk mediatorial system.And finally,folk ADR can become a very important part of the multi-routes of working conflict solutions.
