The Influence on Application of Patent for Invention in Chemical Field Caused by the Changes of Novelty Judgment

新修改的专利法新颖性的判断抵触申请包括任何单位或者个人的申请,文章分析了该变化对化学领域发明专利申请的影响,并提出加强专利法律培训,及时制定专利战略规划,提出专利申请时尽可能"跑马圈地"来避免抵触申请等应对策略。

In accordance with the new Patent Law, novelty judgment involves any entity or individual conflicting applications. The paper analyzed the influence on application of patent for invention in chemical field which was caused by the changes of novelty judgment. At the same time, some strategies, such as strengthening patent legal training, making patent strategy planning timely, the scope of protection as large as possible, were introduced.
