论检察院量刑建议的规范化

On Standardization of Sentencing Suggestion by Procuratoriate

量刑制度改革是中国当前司法改革的重要项目。建立科学合理的量刑制度,确保量刑公正、适当,是量刑制度改革的终极追求。作为享有求刑权的检察机关,量刑建议权是求刑权当然之意。本文从工作实践出发,总结各地检察机关实践经验,分析存在的问题,并立足中国司法实践,对建立规范化量刑建议制度及配备机制提出基本设想和建议。

The reform of sentencing system is now very important,so establishing a proper sentencing system is the ultimate requirement to ensure justice and propriety.Procuratoriate has rights of sentencing claim.This paper puts forward the basic ideas and proposals of how to set up standard sentencing suggestion system and auxiliary mechanism after summing up the practical experience of procuratoriates and analyzing the existing problems.
