全球化环境下商业秘密保护方式的再思考——基于竞业禁止的视角

Rethinking the Way of Trade Secrets Protection in the Context of Globalization: From the Perspective of Prohibition of Business Strife

竞业禁止已成为一种流行的商业秘密保护方式并为许多国家的法律所确认。然而,竞业禁止的普遍使用甚至滥用在一定程度上侵犯了劳动者的劳动权。特别是由于中国相关立法的不完善,竞业禁止并未真正发挥保护商业秘密的作用。全球化环境下,在重视商业秘密保护的同时,绝不能简单地把竞业禁止作为商业秘密保护的主要方式,而应从其他途径出发,思考更能兼顾商业秘密权利人与有关利益关系人利益平衡的保护方式。

Prohibition of business strife has become a popular way of protecting trade secrets.It has also been adopted in the legal systems of many countries.However,the prevalent application of prohibition of business strife has been abused.It violates people＇s right to work.Due to the imperfections of the relevant legislations in China,prohibition of business strife does not play the role of protecting trade secrets.In the context of globalization,trade secrets protection should be emphasized.Nevertheless,prohibition of business strife should not be regarded as the main approach to protect trade secrets.Other ways should be considered to keep a better balance of interests between trade secret rights holders and relevant stakeholders.
