发达国家矿山地质环境保护激励约束机制研究

Research on the Incentive Mechanism of Mine Geological Environment Protection in Developed Countries

矿山地质环境保护是一项系统而又复杂的工程,它的有效开展离不开矿山企业和公民的有效参与。与国外发达国家完备的矿山保护激励约束机制相比,我国建立完备的矿山保护激励约束机制已迫在眉睫。本文拟从法律、经济、行政等方面梳理发达国家建立矿山保护激励约束机制的先进经验和做法,并指出我国应进一步健全矿山地质环境保护法律制度、注重发挥经济手段的基础性作用、健全管理体制,从而提升矿山地质环境保护激励机制的有效性,以促进我国矿山地质环境保护事业的发展。

Mine geological environment protection is a systematic and complex project,and it cannot be ef- fectively implemented without the effective participation of mining enterprises and citizens. In comparison with developed countries,a perfect domestic incentive mechanism of mine geological environment protection is urgently needed. This paper summarizes the advanced experience of the incentive mechanism of mine geo- logical environment protection in developed countries from the perspectives of law, economy and adminis- tration. Furthermore,in order to enhance the effectiveness of the incentive mechanism and to promote the development of the cause of the domestic mine geological environment protection, the paper also proposes to further improve the legal system of mine geological environment protection,to pay more attention to the basic role of the economic means and to improve the management system.
