我国电子产品用户界面保护及模式选择

A Perspective of the Protection Mode for User Interface of Electronic Products

电子产品用户界面是生产者投入了人力、财力研发的智力成果,也是电子产品竞争的主要因素之一,有必要对其进行保护。目前我国法律没有对此保护的明确规定,实践中权利人一般向法院寻求著作权法保护。我国对电子产品用户界面可采取外观设计专利保护,但应对之设置比较高的门槛,以限制其权利滥用,防止企业巨头的垄断。基于保护电子产品用户界面容易产生垄断,对已形成垄断的电子产品外观设计的权利行使也应进行限制。

User interface of electronic products is an intellectual product with human and financial resources, and is one of the main factors to conduct electronic product competition, which is necessary to be protected. At present China＇ s law does not expressly prescribe it and in practice the holder thereof in general seeks to court for copyright law protection. The protection for such can be design patent protection, and in order to limit the rights abuse, prevent the monopoly of the giant enterprises, it shall be set a high threshold. Based on the protection of user interface of electronic products easy to produce monopoly, the electronic product design right which has been formed monopoly shall also be limited.
