我国群体性劳动争议的诉求与处理路径 被引量:7

摘要 对2011年7月1日至2012年6月30日出现在网媒报道中的225起群体性劳动争议事件进行分析,结果显示:在群体性劳动争议中劳动者的利益诉求高于权利诉求;争议过程中存在着暴力冲突;工人集体维权的意识提高但搭便车现象多;少数群体性劳动争议发生之后引致了集体谈判;工会在事件处理中扮演的角色有限;政府对群体性劳动争议的理性定位和积极介入有助于事件的解决;除理论界和实务界,以微博为代表的网媒成为劳动维权的阵地。因此,有必要从工人、工会、企业、政府和网媒五个角度给出处理群体性劳动争议事件的路径选择。 This article analyzes 225 collective labor disputes reported by the network media from Jul. 1 th of 2011 to Jun. 30th of 2012. The results show that: there are more interest demands than right appeals in the events; there exists violent confrontations; rights consciousness of workers has raised but there also exists 'hitchhike' ; some other events leads to collective bargaining; labor unions have played limited role in the settlement of such events but the governments can play an active role; microblog becomes the ground of maintenance of labor fights as well as the theoretical circle and the practical circle. Finally, this article provides approaches to tackle the collective labor disputes from the angle of workers, trade unions, governments, enterprises and the microblog based on the above analysis.
