流转农地用途监管中的县级政府职能分析——基于对河南新安县的调研

County-level Governments' Role in Supervising the Use of Transferred Rural Land: A Case Study of Xin'an in Henan Province

基于实地调研,通过个案透析县级政府在监管流转土地用途中存在的问题。研究显示,在县级政府制定的监管制度中,主体不明、激励缺乏、惩处无力、投入不足是导致监管失效、已流转土地用途改变屡禁不止的主因。要建立政府失范行为的责任追究机制、实施农地流转用途改变事件的"一票"否决制度、加大惩处和监管投入的力度。

Based on field researches, the article analyzes how county-level governments can effectively improve its supervision on the use of circulated land. It shows that ambiguity in the main body, lack of incentives, weak punishment, and insufficient investment in supervision system by county-level governments lead to the ineffective supervision of land use and the repeated change in the use of circulated land. The article holds that we should establish a system of accountability for neglect of supervisory duty, establish the ＂absolute veto＂ system concerning instances of changed use of circulated land, and enact forceful punishment as well as forceful supervision.
