我国企业在实施"走出去"战略时很可能会遭遇一系列专利风险,包括地域性造成的风险、海外参展风险、以专利构筑的非关税壁垒、海关过境查扣的专利风险及美国"337条款"造成的专利风险。因此,企业要树立专利风险意识,设置专利预警机制,建立专利检索制度,完善应对风险措施,并通过自主创新从根本上解决问题。
