大学生勤工助学与实习、兼职的性质及规制

On the Natures and Systems of College Students' Work-assisted Study Program,Internship,and Part-time Jobs

勤工俭学、勤工助学、实习、兼职均为大学生社会实践活动的表现形式。高校现行的勤工助学宜定性为政府、学校帮助困难学生完成学业的一种资助方式,而大学生为获取社会经验、促进就业在校外开展的实习、兼职则属于一种有偿劳动,大学生的身份属于特殊劳动者,适用《劳动法》予以保护。

Work-study program, work-assisted study program, internship, and part-time job are all the chief forms of college students＇ social practice. The current work-assisted study program in colleges should be defined as the assistance conducted by government and colleges to help poor students to finish their study. While the internship and part-time job taken by college students are their paid labor in their spare time so as to gain social experience and to get employment. College students are special workers and should be protected with Law for Labor.
