论我国农村合作医疗法律制度的完善

Research on the Improvement of Legal System of Chinese Rural Cooperative Medical Care

我国农村合作医疗经历了由"集体-农民"合作模式到"政府-农民-集体"多元合作模式的现代转型,其核心价值是农民的社会权利,宗旨是满足农民基本的医疗需求。我国农村合作医疗制度存在着政策单边治理的弊端以及资金运营的风险。要通过积极立法,构建农村合作医疗的法律治理以及强化其法律责任的途径,推进农村合作医疗制度的可持续发展。

Chinese rural cooperative medical care has changed from traditional collective-farmers cooperation mode to modem government-farmers-collective mode with characteristic of diverse cooperation. Its core value is farmers＇ social rights and main purpose is to meet farmers＇ basic medical needs. There are defects of unilateral govemance by policy and risk of funds operation in the system of Chinese rural cooperative medical care. In order to achieve sustainable development of the system, we should construct the mechanism of governance by law and strengthen legal liability through the way of active legislation.
