论政府信息公开语境中的行政服务及其制度完善——兼评《政府信息公开条例》第28条第2款

On the Government Information Publicity in the Context of Administrative Service and Its System Perfection——Comments on the Paragraph Second of Article Twenty-eighth of the Government Information Publicity Regulations

我国确立的政府信息公开制度体现在行政公开与服务行政理念的同时,还对我国服务型政府构建进行了回应。立足于法治政府与服务型政府建设的视角分析该制度仍存在诸多不足之处。因此,应当在遵循政府信息公开立法目的与服务行政理念之基础上,从扩大帮助权受益主体范围、取消帮助权行使条件限制、建构服务给付的正当程序、明确行政服务的救济途径及建立政府信息申请教示制度等方面予以完善。

The information publicity system of our government conform to the trend of the world＇s established information rights leg- islation, which embodies the concept of the publicity of the administration and the service to the administration ,and also responds to the building of service-oriented government in China. The government information publicity in the context of administrative ser- vice system is this concept to the publicity of government information brings the substantive behavior evolution. From the law-based government perspective and the construction of a service-oriented government perspective, the system still has many shortcomings, shall follow the publicity of government information in the purpose of legislation and administrative service on the basis of the con- cept,we should make it improved from the following aspects,which include expanding the scope of the right to help main beneficia- ries ,cancelling the restriction in the use of the help of the right,construction of service payment due process ,clearing administrative service of relief way and setting up a government information of the application of teaching system,ect.
