用人单位遵守社会保险登记时限现状研究——以北京市大兴区的社保登记时限执行情况为例

Study on Current Situation of Employers Obeying Time Limit for Social Insurance Registry——Take the Implementation Situation of Social Security Registry Time Limit in Daxing District as an Example

社会保险登记时限是参保单位和职工参加社会保险的重要时间界限,《中华人民共和国社会保险法》对违反登记时限的法律责任规定并不明确。目前对于新参保单位在执行登记时限规定的情况没有明确过多的关注和分析,对在执行过程中存在的问题研究也相对不多。北京市大兴区2010年7月至2012年6月参保单位的登记时限统计分析表明,建立工商—社保信息互通系统、提供科学的罚金公式等对策建议对用人单位遵守社会保险登记时限有积极的意义。

Social insurance registration time limit is an important time limit for insured units and employees to join social insurance.Social Insurance Act of PRC does not clearly define the legal responsibility of disobeying registration time limit.At present,no much attention and analysis are given to the clear regulation of registration time limit for new insured units,nor to problems existed during implementation process.Analysis of the registration time limit of insured units in Daxing District from July 2010 to June 2012 indicates that advice of building business-social security information exchange system and providing reasonable penalty formula is significant for making employers obey social insurance registration time limit.
