体育仲裁中举证责任分配的研究

Study on the Distribution of Proof Burden in Sports Arbitration

体育仲裁作为程序法的组成部分,其举证责任的分配,应借鉴民事诉讼和普通仲裁的相关理论。在仲裁不同类型的体育纠纷时,应采用符合法律规定和体育纠纷自身特征的举证责任分配标准。可以推测,在将来的体育仲裁制度中,其普通程序适用"谁主张,谁举证",特殊程序适用"举证责任倒置"的分配标准。

Sports arbitration as part of the procedural law, the distribution of proof burden, should use civil lawsuits and ordinary arbitration related theory. Different types of sports disputes should be adopted in compliance with the law and sports dispute characteristics of the burden distribution standard. This paper argues that, in the future sports arbi- tration system, the normal procedures for ＂who advocate, who proof, ＂ special procedures for the burden of the cart before the horse standard of distribution.
