摘要
2009年8月15日中国与东盟10国共同签署了《中国—东盟自由贸易区投资协议》,该协议的签订进一步完善了中国东盟自由贸易区独具特色的仲裁制度。通过深入研究,笔者发现该协议存在提请仲裁的主体范围较窄、仲裁员的选任仍旧不合理、仲裁庭的组织方式缺乏稳定性等问题,并针对上述问题提出了将外国自然人和法人投资者纳入仲裁的主体范围;指定3至4名法律、国际贸易等方面的专业人士组成仲裁员名册;由自由贸易区理事会或类似机构来负责仲裁庭的组建等完善意见。
China has signed " Sino-ASEAN Investment Protocol " with ten countries in AugustlS, 2009. This agreement has improved the arbitration system with free trade characteristics. By deep research , the author found that some problems in this protocol , such as narrow space for submission of the arbitration subject, improper arbitrator selection, lack of the union of the arbitral courts. The author puts forward suggestions that foreigners and legal in- vestor should be involved in the arbitration subjects and 3 or 4 lawyers and businessmen can be listed in, too
