Law Born from the Nature:Value Regression of Suspend form of Dangerous Crimes

对于危险犯,通说的观点否认了危险状态出现后自动而有效地防止实际危害结果发生的行为成立犯罪中止。但是,根据相关理论以及结合刑法典的有关规定,我们发现,这种情况不仅符合犯罪中止的条件,而且也是刑法谦抑性的必然要求。

For dangerous crimes,the general view denies that the behavior to prevent the actual harm results from dangerous state automatically and effectively belongs to discontinuance of crime.However,according to relevant theory and the relevant provisions of the criminal code,we find that,this kind of circumstance is not only in conformity with the conditions of discontinuance of crime,but also the inevitable requirement of the austerity of criminal law.
