基于乡村旅游视角的农村土地发展权问题研究——以湖南省邵阳市隆回县为例

从发展权和土地发展权的起源入手,探讨隆回县土地资源的存量和现有乡村旅游用地的流转方式,揭示在乡村旅游发展过程中政府规划权与土地发展权的冲突,为保护和协调二者的关系寻找到重要着力点,即:乡村旅游开发过程中的利益分配、商业用地的划拨和农村土地所有权人的发展选择权,对于在乡村旅游发展过程中寻求土地发展权的实现方式有重要的现实指导意义。

This Paper, starting from the origin of the development right and land development right, discusses existing land resources and the transfer mode of rural tourism land in Longhui county, which can reveal the conflict between the government planning right and land development right in the development of rural tourism and find an important acting point for protecting the relation between them： The distribution of interests, commercial land transfer and the development option right of rural land owner are of significance for the realization of land development right in the development of rural tourism.
