回顾与瞻望:我国体育法研究范式之研究

Retrospect and Prospect:China's Sports Law Research Paradigm

当学术共同体中一定数量的研究形成比较固定的"套路",即大体相同的基本问题和研究领域、运用类似的分析方法和知识资源,具有共同的逻辑基础,就可以说有了一个研究范式。在分析库恩"范式"理论的基础上,对研究范式的概念、学术功能、确立的标志等进行了深入分析。根据研究范式理论,在借鉴其他学者研究成果的基础上,总结归纳我国体育法学研究的特点,认为我国体育法学研究存在政治法学、立法法学、解释法学和社科法学等四种研究范式,并逐一加以例证,予以阐释。期望通过研究,能概括出我国体育法学研究的大致轮廓特征,对体育法学研究具有一定的参考作用。

When a number of studies in the academic community fixed ＂routine＂, formed, that is substantially the same basic problems and research areas, using similar analytical methods and knowledge resources, a common logical basis, it can be said to have a research paradigm. Based on the analysis of Kuhn＇s paradigm theory, concept, analysis in depth academic research paradigm established signs. Learning from the basis of the research resuhs o~ other scholars, according to the research paradigm theory summarizing the characteristics of Chings sports law research, sports law research in China,I think that there are four research paradigms： political law, legislation law, the interpretation of law and social science law. Expectations of the study, outlined the broad contours of the characteristics of China＇s sports law research, has a certain reference role of sports law research.
