The Construction of Engagement System in China in the Perspective of Comparative Law

婚约在我国民间古已有之,但由于历史原因,在我国现行《婚姻法》中,并未对婚约制度进行规制,使得大量民间婚约纠纷无法可依。基于德、瑞、日等国民法中关于婚约规定的比较分析,无论在理论基础还是实际判决中,确立我国的婚约制度已不存在障碍。在司法实务中,有确立我国婚约制度的必要。

The engagement has a long history in civil society in China, but the current ＂marriage law＂ has not regulated the engagement system due to historical reasons, which has made a large number of civil disputes cannot be engagement. On the comparative analysis of regulations on marriage of the civil law in Germany, Switzerland, Japan, the paper demonstrates the necessity of establishing the engagement system at present in ehina. Whether in the theory or praetical judgment, the engagement system establishment has not the obstacles. And in judicial practice, it is necessary to establish the engagement system in China.
